Todd Smith: "I Did it Because I'm Republican"

This morning I attended a Town Hall meeting hosted by my State Representative Todd Smith, R-Bedford. 

Let me plug the fact that Town Hall meetings, should your representatives have them, are excellent opportunities to directly question your elected officials on votes, authored legislation, or legislation that concerns you that they voted for.  Get in their face!  As BOR has been documenting all week, my personal concern and sole mission for today's Town Hall was to question Representative Smith about his vote in favor of House Bill 218.  Otherwise know as the Voter Suppression Act of 2007.

I asked:

"Representative Smith you voted this week in favor of House Bill 218, which passed with a 76-68 vote.  The bill is inappropriately named the Voter Identification Bill; it should be entitled the Voter Suppression Bill.  If it becomes law this bill will disenfranchise elder seniors, minorities, and young people from exercising their constitutional right to vote, and you supported that.  Why?"

Representative Todd Smith said directly:

"I did it because I'm Republican."

With a puzzled look, my fellow Democratic constituents and I essentially dropped our jaws to the floor.  And he not only said it once, twice, but three times!  The final time he basically insinuated that the Republican Party endorses voter suppression by stating:
"Listen, I'm a Republican, this was a Party line vote, and I uhhhh……voted appropriately as a result."
He went on to ho-hum about the intent of the bill was to keep individuals ineligible to vote away from the polls, which, by his own admission with his bizarre quote, is nothing more then BS.

Smith went on to educate us all that HB 218 requires voters to bring to the polls two forms of picture identification, which most Texans don't carry around whether they are a registered voter or not.  With that said, Smith went on to encourage all  those disenfranchised voters affected by this bill to receive a "FREE" Texas Identification card from the Texas Department of Public Safety.  Free?

According to the Texas Department of Public Safety website, Mr. Smith, the following costs are what one can expect to pay for this "free" identification card in order to vote:

Over 60 - $5.00 (indefinite expiration)
under 60 - $15.00 (expiration 6 years)
plus a $1.00 online fee for the above

If you lose it, it costs $10.00 to replace

If you change your address, it costs $10.00
Plus a $1.00 online fee

As my close Democratic friend whispered to me during Todd Smith's diatribe, "that's a Poll Tax!"  You bet it is, this is Texas reverting to Jim Crow election laws intended to prevent legal, eligible voters from voting and rob us all of a solemn constitutional right.  Who is going to go and get either a $90 passport or a costly Texas Identification card, especially those under certain economic strain, in order to vote?  They just won't vote at all!

Moreover, Representative Smith said that House Bill 218 will allow someone who doesn't have two forms of picture identification to vote through a "separate ballot," or what regular voters and poll workers would call a provisional ballot.  As we all know, provisional ballots are generally not counted and usually thrown away. 

So by Republican Todd Smith's answer this morning, one can logically conclude that the Texas Republican Party endorses Jim Crow voter suppression legislation such as House Bill 218, and I assume also House Bill 626, which is up for vote this coming Monday.

True Courage Action Network, led by John Courage, sent out a call to action encouraging us all to contact our state senators and ask them to vote "NO" on HB 218, and call your state representatives and encourage them to vote "NO" on HB 626, due to hit the floor on Monday for a vote. 

Considering Representative Todd Smith spilled the beans that voter suppression is a Republican staple, you should all be motivated now to hit the phones and express your outrage to his colleagues in the House and Senate.

House Republicans swarm to vote ... hoping that others won't
Republicans have been working to choose their voters - rather than have the voters choose them - since the bitter redistricting fight four years ago.

The bills pushed by Brown and King further that effort to shrink the number of voters in Texas to better gain advantage for Republicans, particularly incumbents.

You need ID papers to get a photo ID too
DPS Identification Requirements.

So we're back to square one.  People who may not have their birth certificate have to pay to get a copy of that.  If you were born in Texas that's about $15.  If you were born out of state it's going to cost more and take longer to get.  Children of US military service members who were born overseas, will also have to pay a lot more to get copies of their documents and it's going to take months.


One note about the Free ID (0.00 / 0)
Smith was telling you about an amendment that Dems successfully added to the bill to allow a voter to receive a state ID for free in order to vote.  I've reprinted the text of it below:

(a)  Except as provided by Subsection (d), the [The] fee for a personal identification certificate is:
  (1)  $15 for a person under 60 years of age;
  (2)  $5 for a person 60 years of age or older; and
  (3)  $20 for a person subject to the registration requirements under Chapter 62, Code of Criminal Procedure.
(d)  The department may not collect a fee for a personal identification certificate issued to a person who states that the person is obtaining the personal identification certificate for the sole purpose of satisfying Section 63.001(b)(1), Election Code, and:
  (1)  who is a registered voter in this state and presents a valid voter registration certificate; or
  (2)  who is eligible for registration under Section 13.001, Election Code, and submits a registration application to the department.

I appreciate the information, that is helpful.  He never mentioned the amendment. 

That said, who will actually go to the DPS, free or not, and retrieve this identification?  Little to no one.

It says "may" NOT collect a fee....not "shall" not collect a fee.

DPS can charge anything they want.

And is it weird that the ID you show to get the free ID is your voter's registration card?

I thought the DPS ID was to verify the voter ID.  And now the voter ID is used to verify the DPS ID?  I just got dizzy.

What's the DPI of this district?  What is the breakdown of self IDs for R, D, Independent?

Todd Smith has run unopposed since 1996, so there is no registered DPI that would be accurate. 

We estimate our DPI in this district to be 32-34%, based on the 2006 gubernatorial results.

We are actively attempting to field a candidate against Todd Smith in order to properly gauge the DPI and be able to rebuild the district more efficiently.

We are also attempting to field a candidate against Vicki Truitt too.

Well, (I know I could look this up, I'm lazy and watching the Mavs play at the moment :) ) I'd far rather see the numbers for Moody (I assume he's the high water mark for a campaign without media) and then if any races were actually in play what the dems got in those in district. 

It is always a good idea to field a candidate everywhere, see what they can actually do (raise money/organize supporters/etc), poll the ones that are working, and then step in and heavily fund the ones that poll well/they have the stuff in place (initial seed money/people on the ground) to win. 

If the DPI is as low as you say it is, this district is absolutely not in play.  Who knows though, the Bell race is the absolute worst indicator due to the two independents, so maybe it actually is.  Any changing demographics since the district was drawn?

After all of the objections that have been made to these bills, both inside and outside the Leg, I don't think anyone can claim they voted for either of them based upon evidence that they are necessary.  Rep. Betty Brown was simply bleeding ignorance trying to defend 218 on the floor this week.

It was worse than Rep. Howard defending his Bible bill, HB 3678:  "The purpose of this bill is...  Regardless of the facts, the purpose of this bill is..."

Kudos to Rep. Anchia for making a valiant effort early on.
