Rep. Vilma Luna to Resign July 31

From the Corpus Christi Caller-Times:

Democratic Party Chairman Alex Garcia and several others confirmed the resignation will be effective at the end of the month.

"My constituents have seen me grow from a single woman to a married woman to the mother of two wonderful boys," she said at a press conference at her legislative office on Gollihar Road. "My family has been blessed many times over, and we tried to give back ... but it is time for my family and I to have more flexibility in our lives."

Luna, D-Corpus Christi, was elected to the District 33 seat in 1993. Luna serves as vice chair of the House Appropriations Committee and also has served on the House Calendars and Ways and Means committees.

The county executive committee (CEC) will meet to replace Rep. Luna on the ballot. The CEC is made up of the precinct chairs from House District 33 (all 45 of them) and the County Chair in Nueces County. Solomon Ortiz Jr. is expected to announce by the end of the evening, and Danny Noyola Sr. is expected to announce as well.

Since the Republican Party did not field a candidate to run against Rep. Luna, they will not have anyone on the November ballot, and the seat will remain Democratic.

Rep. Luna served as Vice-Chair of the House Appropriations Committee. In addition to who replaces her in her district, it will be interesting who is appointed to serve as the new Vice-Chair in January.

Texas Election Code 145.036 states -

"(c)  Under the circumstances described by Subsection (b)(2), the appropriate executive committee of each political party making nominations for the general election for state and county officers may make a replacement nomination for the office sought by the withdrawing candidate."

So it appear Republicans CAN run someone for Luna's seat.  Whether they will and whether or not the seat is vulnerable are separate issues.

But that's only for parties that have made a nomination for the general election. Since they made no nomination, they can't make a nomination.

Seriously, I thank Luna for her service to her district, slightly less so for her closer than comfortable ties with Tom Craddick over the past session or two.

Why it's not OK for Tom Delay to withdraw from the ballot and be replaced by a party committee, but it's OK for Rep. Luna to do so.

One of my best friends asked me the same thing, and I didn't have an answer.
Of course, we're also talking about what's "right." The thing with Delay is a legal issue -- that they're trying to coordinate a replacement before he is officially off the ballot. If the same is happening in Nueces County, I'd imagine the same argument could be made against Rep. Luna -- but I don't think it's come to that, yet. Maybe others can clear that up for me a little better.

Then again, her district, as Kuff notes, is relatively purple, what w/ Bush gaining 54% in 2004. It seems that either (a) she didn't announce her resignation until now to ensure no Republican would take the seat, or (b) something came up, recently, that has forced her to resign. One blogger has speculated that she's planning on running for a newly drawn congressional district, which is an interesting notion to kick around until we have a clearer picture of what happened.

Let's not forget, she sat on Joe Crabb's Redistricting Committee, and along with the departed and definitely unlamented Ron Wilson, helped foist the DeLay redistricting scam on the state.

His dad is such an institution in the Corpus Christi/Brownsville area, I can't see anyone other than Jr. getting the Dem nomination. And if so, Jr. would also be a lock for Congress when Sr. retires.

First, Ortiz has not yet announced.

Second, this field may get really crowded real fast. There are a lot of good folks in Corpus who have waited a very long time for this day....
