5th Circuit Denies Greg Abbott's Attempt to Rehear Texas Sex Toys Ruling

It looks like the 14th Amendment is going to win out over Texas Republican Attorney General Greg Abbott.

The 5th Circuit Court of Appeals has rejected a request by Abbott to have the entire circuit court re-evaluate a ruling made earlier this year that found a Texas law banning the marketing and sales of certain sex toys an unconstitutional violation of the right to privacy under the 14th Amendment. Any appeal would now have to be made and accepted by the United States Supreme Court and there is no word from the AG's office if they will seek to do so.

Houston Chronicle: Companies that own Dreamer's and Le Rouge Boutique, which sell the devices in its Austin stores, and the retail distributor Adam & Eve sued in federal court in Austin in 2004 over the constitutionality of the law. They appealed after a federal judge dismissed the suit and said the Constitution did not protect their right to publicly promote such devices.

The appeals court struck down the ban in February, ruling that it violated the right to privacy guaranteed by the 14th Amendment.

I believe that prior to this ruling, certain toys, if owned, had to be considered "educational or instructional" devices.

This is silly waste of tax payer's money that Abbott needs to let go...there are bigger fish to fry than trying to shut down small businesses that market adult toys.

Experts have continuously pointed out that these are often used by married couples to enhance their relationship...also, many seniors and physically disabled also benefit.

Lastly, you can't legislate sex.  Why doesn't the Republican party get that??  They tried to abolish teen-age sex in West TX with legislation and they created "THE LARGEST OUTBREAK OF TEENAGE SEX IN THE NATION'S HISTORY"!!!  Way to go Repubs!!

I can only guess this is silly pandering to a right-wing religous movement that is out of touch with reality.  This is a moral and individual decision, not a policy decision...just like abortion.

The fact is YOU CANNOT LEGISLATE SEX!!! Folks will find a way to get toys, or they'll find a way to have an abortion...etc.  The best that a silly law like this can do is increase the underground movement of such activity.

Wake-up Republicans...and go out and get a sex toy and have some great sex and fun with your wife/husband! :)

might should keep a closer watch over their own conservative flock.

Based on this, I have to wonder how many sex toys conservative Republican Pete Sessions has? Maybe it's only one, since he's conservative.
