Vietnam War Dodger Senator Cornyn Demands Decorated Veteran Noriega's Military Records?

Now why would our distinguished junior Senator from the great state of Texas want to examine the military records of the Democratic candidate for U.S. Senate, Lt. Col. Rick Noriega?

For what purpose?

I think we all can guess at the reason.   Let's put it this way. Cornyn dodged the Vietnam War when he could have served in the military, but he instead actively sought a way out.  Lt. Col. Noriega, on the other hand, enlisted in the National Guard in the 1980's in response to the Iranian hostage crisis.  He later served in Afghanistan as a result of 9/11 and the war on terror.  

But this is an election year and it obviously has dawned on Cornyn that he had chosen to shirk his walk while Lt. Col. Noriega has walked his.  And so now we have a threatened and scared Republican Senator who will fabricate smear for the sole purpose of saving his own scared and sorry derriere.  

I don't think any of us will ever forget the relentless and unconscionable swift boating of John Kerry in 2004, who unlike Bush, did serve in Vietnam.   And Bush supporters smeared Kerry mercilessly for it. Yes, folks, this is the sick, twisted and toxic manner in which Republicans and their supporters thrive. The pathetic cowards will smear and demonize decorated war heroes. GOP smear mongers have no honor. They don't even know its meaning.  

Like W., Texas U.S. Senator Cornyn did not serve in the Vietnam War.  Both men were of military age at the time and as we know, both are right wing war hawks today. And yet neither was willing to fight in a war themselves when they had every opportunity to do so. While W. his behind his Daddy's clout and buddies to dodge Vietnam, Cornyn bailed out by using a loophole in the law.  

Clueless about the hard and real consequences of warfare, an inept Mr. Bush distracted us from the real war on terror by fabricating an unnecessary debacle called Iraq.  His equally oblivious and war dodging soul mate, Mr. Cornyn has blindly and routinely supported W. in his irresponsible quest that has undermined our military as well as our national security.  70% of Americans believe Iraq is a mistake and not worth the price.  So much for putting chicken hawks in high positions of power that involve decision making about warfare, our military or our national security.  Not to mention the inconvenient truth about our now busted and seriously overdrawn national piggy bank.  

It is apparently so easy for swaggering war dodging chickens to send others off into the killing and maiming fields and squander our national treasure while the chickens roost safely at home completely insulated by bastions of personal financial protection and fortresses of political power.    

A couple of months ago progressive bloggers, Vince Leibowitz, Hal Heitman, and I put our keyboards together to do a little research on Cornyn's military history, or rather, the lack thereof.  We knew given Cornyn's age that it is likely he had to have participated in the mandatory Vietnam War draft lotteries of the 1970's  During the time in which so many men Cornyn's age were drafted into military service we wanted to know why the Senator was neither drafted nor did he enlist.  

Vince had discovered an article written in the San Antonio Express News on October 20, 2002 (Section A, page 12) that revealed Cornyn avoided the Vietnam War draft by obtaining a student deferment in 1970.

In 1970, Cornyn requested and received a student deferment from the draft, which was abolished shortly before he graduated in 1973.  

"There was a lot of soul-searching going on and a lot of questions about our nation's role in the world," he said. "Ultimately, I turned out to be pretty much a chip off the old block."

I'd say there was a lot of soul searching all right.  Cornyn chose to shirk the walk.  Chip off the old block?  How so?  According to Senator Cornyn's web site his father is a former B17 pilot in WWII and he served in the Air Force for 31 years.    

Actually, the fact that Cornyn received a deferment in 1970 is kind of odd given that student deferments were supposed to have come to a screeching halt in 1970.  The entire rationale for the draft lottery was to even the playing field for those being called into service.  Prior to the lottery student deferments were possible for those enrolled full-time in four year colleges/universities who maintained average/passing GPAs.

Our interest in this issue peaked when strangely, as Vince had discovered, the statement in the San Antonio Express conflicted  with one written in the December 14, 2007 issue of the Texas Observer by Jan Reid.  In the article about Mr. Noriega's military service ("Boots on the Ground") the author had stated Mr. Cornyn was too young to have served during the Vietnam War.

Too young?  Vince, Hal and I knew better.  Hal, like Cornyn, was of military age at the time and he had to participate in the Vietnam War draft lottery himself.

I am also a baby boomer whose own brother, born the year before Cornyn and one of my brothers-in-law, born a year after Cornyn, also had to go through the draft lotteries.

So, what is Cornyn's story?  

Hal dug through the Selective Service archives and learned that Cornyn did indeed go through the draft lottery system in 1971 and he drew number 28, which is a very low one. You see, those with numbers 0-95 were to have been called into service.
 

Why did Cornyn go through the draft lottery in 1971 if he received a supposed deferment in 1970?    

The fact of the matter is, back in the Vietnam War days deferments were next to impossible to obtain for the young men who followed their fathers into the trades, or for those who did not have the financial resources at the time to attend school.   These are the groups that bore the brunt of the draft and most were shipped to Vietnam immediately after basic training.  Far too many returned home in body bags.

Fortunately there are times in America when people cry out for justice and fairness for all.   During those turbulent Vietnam War times the public grew outraged because so many of the working class and poor citizens were shipped off to the killing fields while the wealthier young men could escape that fate by enrolling and remaining in a university or college.  Many of our lawmakers at the time had served in the military themselves and they understood the public's rage and frustration.   And so after enormous public pressure, the draft lottery evolved in an effort to add a degree of fairness to the draft.   Here is a snippet on its mission and how the lottery was supposed to have worked.

To make the lottery as fair as possible, the National Institute of Standards and Technology (NIST) developed a unique random calendar and number selection program for Selective Service. Using this random selection method for birthdays, each day of the year is selected by computer in a random manner, and that date is placed in a capsule. The capsules are then loaded in a large drum on a random basis. By the same method, numbers from 1 to 365 (366 for men born in a leap year) are also selected in a random fashion, placed in capsules, and the capsules are placed into a second drum. The process, repeated a second time, results in two sets of drums. Official observers certify that the capsule-filling and drum-loading were conducted according to established procedures. This certification is secured to each drum; they are sealed and placed in secure storage. Should a lottery be conducted, one of the first actions would be an inspection of these stored drums and the selection of a set to be used in the lottery.

So much for the NIST's mission of fairness where Cornyn is concerned.

Because Mr. Number 28 Cornyn avoided the draft.

Last night while writing this diary, I received an email from Hal.  As a result of his persistent research efforts he finally discovered how Senator Cornyn had ducked the draft.  

According to Hal:

Even though the lottery was instituted in 1969, and meant to level the playing field and deny young men the opportunity to avoid military service by going to college, people were still allowed to apply for and were granted education deferments, aka 2-S deferments, up until September 1971. These deferments did not vaporize, they were held in force after 1971. This is how Cornyn was able to maintain his student deferment while others in his age group went to Vietnam.

So, a man who cowered behind a 2-S deferment has the arrogance to demand the military records of decorated veteran Rick Noriega?

I am convinced that Vietnam War dodging Senator John Cornyn fully intends to swift boat Lt. Col. Noriega and his service in Afghanistan.

If the junior Senator from the great state of Texas thinks that we Texas Democrats are going to let him, Rove and members of the GOP smear a Texas war veteran and demean his military service, these boys and girls have another thing coming.

Texas Democrats don't let Texas Republican Chicken Hawks smear Texas war heroes.

Texas Democrats, and any revolted and sickened Republican who may be reading this diary, I urge you to go to Lt. Col. Noriega's website to sign the petition against Senator Cornyn's swift boat attacks. Let us put a final end to the Republican hate machine that is fueled by falsely fabricated personal smear attacks, sleaze and slime.  This machine is hostile to whom we are as a people and serves only to hurt us as a nation.  Hate cannot engender anything good, positive, uplifting or worthwhile.

A special note of thanks to Vince Leibowitz and Hal Heitman who contributed research materials for this post, and to Randy Erb, for his input and for his service and contributions as a Vietnam War Veteran and former draft counselor.  And a big thank you and hugs to my brother and one of my brothers-in-law who went through the draft lotteries as full-time college students in excellent academic standing, with no deferments available to them at the time.

Another person whom I don't even know also inspired me to write this piece.  He or she deserves a rather extraordinary applause for his or her heroism, integrity and bravery.   Let all of us in the Texas Democratic Party give our deepest and most heartfelt thanks to real hero who donated a portion of his or her re-enlistment bonus to support Rick Noriega.

There was a time, not so very long ago, when Americans used to be more like "Soonergrunt" and less like Cornyn, Bush, Rove and Co.

The draft lottery and deferments were separate issues. The lottery was introduced in 1969. New student deferments were not phased out until 1971. At that time, students already enrolled and holding deferments were allowed to keep their deferments until their class graduated.

Cornyn is open to criticism as a war hawk who dodged service himself, but there's nothing special or nefarious about Cornyn's situation in 1970-1971 regarding how the draft worked.

about labeling everyone who got a student deferment during the Vietnam War as a draft dodger and coward.  I think the chicken hawk label is appropriate due to Cornyn's (and Bush's) later hypocritical war mongering, but many young men of the era requested and received deferments not out of cowardice but out of principle.  I wonder whom among us would be willing to be sent to Iraq if a draft was in effect now.

The fact of the matter remains that Cornyn was able to receive a deferment when not all young men his age could, including those in college.  College deferments apparently ended for some, but not for all.   Cornyn is a chicken hawk b/c he has no problem with sending others off into battle when he himself  hid behind a 2-S deferment. Most men who had the college deferments at the time are not warmongers today like Cornyn is. And now he is preparing to smear Rick Noriega's service in much the same fashion the W. people did it to Kerry.  If Cornyn is going to attack Noriega for his service, Cornyn needs to be called on his own failure to serve.  Fair is fair.

Based on this post, you must have voted for Perry over Sanchez in 2002.  Let's recap: Perry volunteered for military service during the Vietnam War, while Sanchez applied for and received numerous student deferments.

dude.  This is about a person who occupies a position of power in the U.S. Senate and this person voted to give W. the authorization to go to war in Iraq.  That means our military was shipped to a place we didn't need to be and over 4,000 of them have been killed and tens of thousands of others have been maimed.  Do you care?

This is about how a warmonger is a chicken at heart.  And now that chicken hawk thinks he can smear a decorated war veteran.

Democrats in this state aren't going to let him get away with it.

I'm still unsure of what Noriega has to fear in his military records.  He should be proud to make his records public.

Noriega has nothing to fear where the reality and truth of his service is concerned. Cornyn hasn't requested the records for any reason other than to search for something to distort and turn into lies. History tells us that this request was made in preparation of a Swiftboat attempt.

That's not true. All men his age enrolled in college were allowed a student deferment. It's the men younger than him that were not given a student deferment, as new student deferments ended in September, 1971.

Let me put this in perspective.  A friend of mine sent me a link to a rather interesting piece written by Paul Craig Roberts today in which he expresses his opinion on the Bush (W) administration.

Paul Craig Roberts wrote the Kemp-Roth bill and was Assistant Secretary of the Treasury in the Reagan administration. He was Associate Editor of the Wall Street Journal editorial page and Contributing Editor of National Review.  A pure-D conservative republican..

the truth matters when he smears the daylights out of Rick Noriega's military service.  Tell Cornyn the truth matters when W. lies to the American people about how there were WMD and links to Al-Quaeda in Iraq and Cornyn continues to stand by him.  Tell Cornyn the truth matters about poverty and the disenfranchised when he shows his contempt for the poor by voting against the SCHIP bill.  Tell Cornyn the truth matters when our state's schools rank 2nd to last nationwide and our children are undereducated to the point many cannot find jobs that will sustain them.   The GOP solution?  Don't educate our kids.  Jail them instead.  

Don't you lecture me, sir, a private citizen who is expressing my right to freely state my opionion, which this time, happens to be supported by the fact that Cornyn hid behind a deferment and now the hypocrite is going to tear up Noriega b/c he has the bucks to do it. Other political activists, bloggers and I are not letting this go.  If Cornyn smears Noriega, we will call him on it.

It is up to bloggers, such as the Burnt Orange Report and other local progressive blogs to get the truth to the people.  Our state's media sure as hell haven't done their job in that regard.

The only way it can take the focus off its ineptitude is to attack the opposition.  Unfortunately for America this has worked for the GOP in the past.  Voters hold some responsibility here because we allowed ourselves to be swayed by the attacks.

It is up to us, the people, to expose the Republicans for whom they are and for what they have done to our nation and to us.  It is up to us to say we have had enough.  Say no to swift boating politics.

Great job!  I am 67 now but remember well my dealings with the draft board. In my case, I dropped out of school at the end of the first semester and what seems like days later I had mail from the draft board. I was in basic training in April after I joined the National Guard. I traveled to the next state to find a unit with openings so you should understand that a guy had few options at the time.  Everyone was aware that you stayed in school, enlisted or joined the National Guard and there was very little time to ponder the alternatives.

Senator Cornyn was not drafted because he worked at it.  He did what he had to do to stay out of the military.  It was no accident that he did not happen to serve.

Keep up the great work.  I hope to meet you finally at the convention.

I don't think it's a big deal to simply ask for Noriega's records (0.00 / 0)
To read this thread, you would think that the swiftboating had already happened.  All that's happened so far is a request for Noriega to make his military records public.  I'm sure a lot of voters would like to see those records, since military service is the centerpiece of Noriega's campaign.  

Noriega should have released those records as soon as he decided to run.  Of course people were going to ask for them, and it has become a virtual requirement for any former military member who is seeking public office.  This is a basic part of transparency in government, and until an attack is made, I don't see the need to preemptively defend Noriega.

Let's also not forget that the original swiftboating of John Kerry had absolutely nothing to do with the release of his military records.  It had everything to do with a few guys who served with him making bogus claims about his purple hearts, which they could have (and would have) done whether Kerry had released his military records or not.  The release of his military records helped to vindicate Kerry, if anything.

If there is something negative in Noriega's military record, then the public deserves to know, and yes, Republicans will use that part of his record against him.  No doubt they would like to find some dirt in there, and this is the only reason for their request.  But this is not swiftboating, if there really is a blemish on his record.  Swiftboating occurs when political hacks cast doubt on the unblemished service record of a decorated veteran using a public slander campaign.  If Noriega's record of service is exemplary, and I have no reason to believe that it is not, then the public release of that record alone will not result in him being swiftboated.  And since he's so cozy with Bob Perry, he should have nothing to worry about from the swiftboat crowd anyway, right?

Who seem to be misunderstanding swiftboating, and that release of Noriega's military records will not lead to him being swiftboated.  I'm sure most BOR readers understand swiftboating just fine.

There was no contact between McMurrey and the RPT on this, which makes it disingenuous to say that they were teaming up.  I hadn't seen anything where McMurrey asked for the records, but if he did, it's a perfectly legitimate request.  Why is everyone being so defensive?  Releasing military records is standard procedure for veterans who run for office.

I hadn't seen this yet.  So do you think it's lame that McMurrey is releasing all his records as well?  He's running on his record as a public servant just like Noriega, it seems uncontroversial that they would release records about their service.  Transparency in government is a big thing, and that applies to campaigning as well.  Are you against transparency, or just against Democrats agreeing with anything Republicans say?

It's important to point out here that McMurrey has not asked Noriega for the records as the RPT has, just called on him to release his records to the public in tandem with McMurrey's own release of his teaching records.

It's really too bad you guys can't find anything serious to criticize him for. But maybe that's because he doesn't have ties to Big Energy, doesn't take money from lobbyists and didn't vote "present, not voting" on the resolution to support the "War on Terror." That's a real progressive for you!

I mean, really. Do you really think we're "teaming up with the RPT?" If so, I think you may be sleep-deprived and delusional.

We all know he's going to have to release his records sooner or later. Might as well get it out of the way. I don't like that the RPT asked for them either, but Noriega could have blunted this by releasing them earlier. He had to know that this would come up.

I know that our campaign will completely back Rick up if any swiftboating occurs. Trust me.

Trust me."  Then maybe McMurrey supporters could lay off swift boating Rick themselves by demanding he show his records b/f Cornyn-The-War-Dodger shows us WHY and HOW he copped a deferment.  WHO authorized it?  Why should Rick cave in to Cornyn when Cornyn is the one who has something to hid.  Don't forget who the real enemy is, thank you.

Is not swiftboating.  Get that through your head.  If he wants to run on his military credentials, he needs to release his record, pure and simple.  

If you want John Cornyn's draft records, maybe you should ask him, not us.  And I really doubt Noriega wants his public position to be "I won't show my records until you show yours."  He should take the lead on this by releasing his own records, because it's the right thing to do, regardless of what Cornyn does.

Also, how are we "swiftboating" Rick? We've never said ANYTHING negative about his military service. I should know, because, having served and come from a military family, I would never "swiftboat" another veteran.

The only "swiftboating" going on is your poor attempts to tie our campaign to Cornyn. Which is ridiculous considering we're far more liberal and progressive than Noriega.

Cornyn is a war hero! He was on the front line during congressional hearings. Taking cover behind enemy file cabinets. Crouching under his desk. He listened while ringtones whizzed by his head.

What did Noriega do besides live in a hell hole called afghanistan for 14 months, live in 3rd world conditions, get fired at, be away from his family, eating dirt, and serving his country?

As a Houston Vietnam volunteer, I can tell all who would hear that, quite simply, Senator Cornyn is a coward not worthy to be an American. That he occupies his high office is a matter of shame for all Texans who love their country.
