Major Rule Fight; Roll Call, Quorum Broken

Stand in Speaker Rep. Sylvester Turner (D) along with Keel and Wilson is now disregarding even a motion to Adjourn, which is being used as a test case to force a ruling on which motions "shall be in order" to be recognized. It's a new battle of wills and rules between Rep. Dunnam and the chair now.

Follow in the comments. Personal privledge speeches and rule debate seems to be on docket.

WHOA. There is an informal roll call vote going down on the floor right now by Rep. Haggerty (R) of El Paso. Haggerty gets stalled out twice by the Speaker but keeps forging ahead. He then asks members to follow him out of the house, D and R alike since he's not being allowed to continue with his informal roll call.

QUORUM BUSTED! 

"The Record vote shows an absense of a quorum. The House will stand adjourned until 2 pm tomorrow (Monday)." 

UPDATE from Matt Glazer:  As the members, Republican and Democrat alike, walked out of the chamber, they were followed by every person in the gallery.  Suddenly, the entire capitol errupted in applause.  It is a mad house here.  Nobody expected this.  Haggerty read member by member asking were they stood. When Sly Turner told him he was no longer recognized, he asked members to join him by leaving. The feeling here is incredible.

With the "motion to vacate the chair," at least they could pretend that the Speaker wasn't obligated to recognize the member because the motion itself was illegitimate using the tortured reasoning that the Speaker was an "officer of the State."

The motion to adjourn, on the other hand, is an undisputably privileged motion, and it is the highest of privileged motions.  It is a parliamentary abomination for the Speaker to compel the House to stay in session if the boy wishes to adjourn.  If a member wishes to offer a motion to adjourn, the Speaker has the right not to recognize him.  The Speaker may not, however, proceed to the consideration of any business of lesser precedence than the motion to adjourn before he recognizes the member who seeks to make a motion to adjourn.  Not even the Speaker of U.S. House--the most powerful presiding officer of a parliamentary body in the world, so far as I know--has this kind of authority.

It is a firm principle of parliamentary law that should the presiding officer persist in refusing to the put a properly formulated question to the body, a member of the body has the authority to put the question to the body and take a vote upon it.  That point has been reached tonight.

Speaking as one who knows far more about rules of order than anyone should, this is an outrage upon the dignity of the House of Representatives of the State of Texas.

Mostly I'm interested in seeing Craddick go down.  But I also have an interest in seeing Stat Parks fully funded.  If I understand correctly, HB12 raises the sporting goods tax cap (and transfers historic sites, but I won't go into that now).

But the money has to be appropriated through HB1, which is now approved.  During the HB1 debate, Hilderbran and Chisum made a point of saying that money appropriated for state parks in HB1 does depend on HB12 as the means for the funding.

With HB1 passed, and HB12 out in the rain with no quorum, what happens to the funding laid out in HB1?

Most likely the Session is done on the House side.

Craddick will still hold some power in the interim (for example as one of the members of the Legislative Budget Board) which is useful, but anything does in that role can easily be undone by the 81st if he is no longer Speaker.

The Senate will become AMAZINGLY powerful over the Interim.

Butter Woman is concerned about HB12, Parks funding. I heard a statement (Hildebrand?) that somewhere in the appropriations bill(s?) it says that some(all?) Parks funding is contingent on passage of some other legislation. I'm guessing that is probably HB12.

HB12, as it came from the Senate (I have been told), did not lift the $32M cap, did not dedicate sporting goods sales taxes to Parks, and did not transfer historic sites to the THC.

Does anyone know what happened regarding the above three issues in the conference committee? I can't find the text of the CC report.

Parks Funding/Transfers (0.00 / 0)
TRB, I've been following the funding/transfer issue, and started being anti autoCraddick based on his ham-handed manipulation of HBs 6, 7, and 12, as well as SBs 900 and 1848. (The over-the-top handling of House rules/parliamentarian/privelege/recognition/vacate issue really did it for good for me, and , hopefully, everyone else.)

When HB12 went to the Senate, it included transfer of 18 historic sites. When it came back from the Senate, the transfers had been removed. autoCraddick's position had been to withhold Parks funding unless historic sites were transferred to his good buddy ($$$) john nau (big beer salesman and THC chair). I'm trying to find out whether Harvey (DittoHead) Hildebrand got the historic sites transfers back into HB12 at the CC.

No way would he disappoint the Silver Eagle, coup or no coup.  There are still 18 historic sites on the list in the Conference Committee Report.  No word on the fate of the "study" language.

This is one of the lowest of Craddy's low blows to the people of Texas, selling our historic sites to his buddy (THC Commissioner John "Skeletor" Nau) and holding parks funding hostage to get 'er done.  EVIL!

Thanks, I now have the text of HB12 CC report and also the side-by-side analysis. Summary: 1) Lifts cap; 2) Transfers 18 historic sites; 3) Mandates a study of sporting goods tax for Parks - due 12/08; 4) Sunset reauthorization for THC thru 2019; + misc.

Hmmmm... Re: #4 - Wouldn't it be ironic if THC's sunset re-up somehow didn't make it through...??
