Jennifer Kim Campaign Behind Anonymous Robocalls in Place 3 Race

Early I posted about apparent anonymous robocalls in the Austin City Council Place 3 race between Jennifer Kim and Randi Shade (oh, and Ken Weiss).

Well, it appears they may not so anonymous after all and indeed are from the Jennifer Kim campaign.

The number used to call has been previously identified as one used for Kim autocalls.

The issue now- is "Lisa" enough of a disclaimer for the Kim campaign to not be breaking the law? (Ironic given yesterday's 'ethics' hullabaloo?) Jeff Crosby points this out in the comments on the prior post.

It's against state law (Texas PUC Regulations).  Robo calls that fail to properly identify the caller within the first 30 seconds of the call are illegal.

And for those not convinced this is from the Kim campaign, two scans of the latest attack mail from her campaign are below the fold. The messaging is the same.

That "sentence" on the back of the mailer is gibberish. It says that Randi Shade is "the highest paid police and firefighters in the state," thereby making "in seeking their their endorsement" complete nonsense. Doesn't anybody proofread anymore?

that refers to the Austin police and firefighters (the 'their' from later on).  Although if I was a style Nazi I'd rewrite it to say, "Already the highest paid police and firefighters in the state, in seeking their endorsement Randi Shade..."  It's a little awkward either way, I'd admit.

"Randi Shade" is the subject of the sentence. Therefore, "already the highest paid police and firefighters in the state" is a clause modifying the subject. That's no different, grammatically speaking, than say, conflating the Capitol and a person. "Completed in 1888, Senator Obama said that..."

I knew what the sentence was trying to say. I just thought it was said very badly. For something that should have been thought out very carefully, it wasn't even literate English. I guess that makes me a style Nazi.

this will sink Kim's campaign.  Anonymous negative robo calls will backfire...big time.  Voters are tired of this nonsense.

If you're gonna attack Randi, a lifelong public servant who served proudly under Ann Richards, at least have the guts to put your campaign's name on the negative robo call.  Hiding behind some anonymous neighbor named "Lisa" is pathetic...and possibly an ethics violation.

I received a negative attack ad from the Kim campaign. I guess their targeting is either spot on or totally off, because while they did ID a likely voter, they sent it to one in their opponent's friggin' COMMERCIAL.

Ooops.

I'll bring it to the party tomorrow. :-)

And I haven't gotten any political mail for the runoff so I suspect that it was some targeting including the primary voters. My voter history is so messed up from moving it back and forth from Austin and Fredericksburg so it kept getting destroyed. Oh, and Massachusetts as well.

As if anybody doubted it - it's just about keeping power. She changed from the candidate who said what the developers liked to hear against Dealey to the candidate who says what the Old Money Neighborhood guys like to hear now.

The amazing thing is that the BATPAC crew was dumb enough to buy it. Do you think she's really going to do what you want if she gets re-elected? Dealey, sure; I understand whole-heartedly supporting her if you were of that stripe. I bet she would have done what she promised. But anybody who believes Kim now is just an idiot.

with a simple complaint to the PUC, the Shade campaign (or any other party) can get a full-fledged investigation.

screaming from the rooftops that the Kim campaign is saying that APD and AFD are overpaid. That's another benefit of this poorly written piece. It wasn't even necessary to the point of the mailer to say that APD and AFD are the highest paid in the state. All it had to say was that a promise of some kind was made. Why even bring up what they're paid? Shade's campaign should be saying that Jennifer Kim doesn't appreciate the police and fire departments and is just bitter (this year's buzzword) because she didn't get their endorsements.

The mail has the "paid for by the kim capaign" disclaimer stuff on it (the black on maroon part on the first side) and the calls are from one of Ignite Consulting's robodialers (who is Kim's general consultants/campaign managers).  From there you can make of it what you will.

PUBLIC UTILITY REGULATORY ACT (2.50 / 2)
SUBCHAPTER F. AUTOMATIC DIAL ANNOUNCING DEVICES

Sec. 55.127. CONTENTS OF RECORDED MESSAGE.
(a) A person may not use an automated dial announcing device to make a telephone call in which the device plays a recorded message when the connection is completed unless the recorded message states during the first 30 seconds of the call:
(1) the nature of the call;
(2) the identity of the person, company, or organization making the call; and
(3) the telephone number from which the call is made.

Sec. 55.138. CRIMINAL PENALTY.
(a) A person commits an offense if the person owns or operates an automated dial announcing device that the person knows is operating in violation of this subchapter.
(b) An offense under this section is a Class A misdemeanor.
(V.A.C.S. Art. 1446c-0, Sec. 3.657(b).)
