Tom DeLay Indicted On One Count of Money Laundering

The Austin-American Statesman has the story.

Apparently the first indictment again Rep DeLay was not a crime in 2002. The DeLay legal team is going to seek dismissal of the first charge.

Now the AP has a story that Rep. DeLay has been indicted on one charge of money laundering.

According to the Statesman though:

"In a letter to Earle, DeGuerin said DeLay is withdrawing his waiver of the statute of limitations to investigate him. Last month DeLay signed that waiver in an attempt to head off an indictment.

So it seems as if DeLay might walk because the statue of limitation for the crime has expired.

This is just working from memory, but I believe the statute of limitations expires next month, actually. I'm not a law student, but I think that as long as he is arraigned befoe that date, he can still be tried.

No one here too upset that Earle sought an indictment against a citizen for something that wasn't even a crime at the time?!?! Shouldn't our DA know what the law was and wasn't before pursuing an indictment? Or is that asking too much of Earle and his large team of taxpayer-funded lawyers...

This is nothing more than a giant case of CYA on Earle's part.

UT law professor George Dix said he believe the statute that would support the conspiracy charge was in effect in 2002. It was just readressed in the 2002 Lege session.

I finally found the AP version that includes the info from Dix. It had been in the Chron story but was missing when I went back to reference it.

There sure is a lot of reindictment going on which in itself raises a question as to the validity of the indictments themselves.

Sort of reminiscent of a cow patty tossing contest. Keep tossing them at the wall until one of them sticks.

To, Bady Snooks, that is the name of the game in our land of freedom and mass prisons and open borders and terror war, its always been that way and tossing cow patty is normal.

oh yes, CYA Is also one other way to carry on political business, you know like bush and clinton did so many times. we will see many more indictments for the political show, that must be carried on for the people, for the reason of so called order and laws that only are deal's made for that show with show to keep you from seeing it as it really is.
