Here are the Constitutional Amendment Endoresements by the Austin Chronicle. Their verdict?

Yes: Good Law, Even If Not Constitution-Worthy - Props 1, 7, 10, 21

Yes With Reservations: Probably Good Law, but Shouldn't Be in the Constitution - Props 6, 11, 13, 14

No, With Reservations: Questionable Law, but Not as Bad as Proposition 12 - 2, 9, 15, 16, 17

No. Bad Law. Bad, Bad Law. (But Still Not as Bad as Proposition 12) - 4, 5, 8, 18, 19, 20, 22

Hell, No! - 3, 12

The current system is Lotto for Lawyers and I, for one, am tired of about half my medical costs going towards purchasing tickets for them to play.

Natalie, California has had a tort reform system very close to the one that will be created if 12 is passed for over 15 years now. The malpractice insurance rates rose there by the same ammounts as the rest of the country because it has nothing to do with lawsuits. 5% of doctors make up 90% of the malpractice suits in this country- it has nothing to do with "Lotto for Lawyers" it is insurance companies scamming people and bad doctors getting off scott free.

Why does the legislature need specific authorization by voter initiative to cap malpractice verdicts? Doesn't it already have that authority? Or is there a constitutional hurdle somewhere?

There was a bill signed around the late 80s for caps on lawsuits, but it was brought down by the TX Supreme court. Is that what you were talking about?
