Judge Sharon Keller Charged by Commission on Judicial Conduct

by: Karl-Thomas Musselman

This is breaking news from the Statesman via email. Texas Criminal Court of Appeals Judge Sharon Keller will have to face a public hearing after receiving charges from the Commission on Judicial Conduct.

The state Commission on Judicial Conduct has charged Sharon Keller, the presiding judge of the state's highest criminal court, with bringing discredit upon the state judiciary for denying a death row prisoner the ability to file an after-hours appeal in 2007. Keller will face a formal, public hearing to answer the charges and could be removed from office, reprimanded or exonerated.

Keller violated judicial canons, state agency charges

By Chuck Lindell | Thursday, February 19, 2009, 03:23 PM

(snip)
"Judge Keller's willful and persistent failure to follow (her court's) execution-day procedures on Sept. 25, 2007, constitutes incompetence in the performance of duties of office," according to a notice of formal proceedings from the state Commission on Judicial Conduct.

The Texas Supreme Court will appoint a special master - a sitting judge from outside Travis County - to preside over Keller's trial, which has yet to be scheduled.

Keller will be allowed to present evidence, raise objections, and call and cross-examine witnesses in a forum that will resemble many civil court trials, said Seana Willing, executive director of the Commission on Judicial Conduct.

This woman embodies my reason for steadfastly opposing the death penalty. Regardless of your moral/ethical/religious positions on the issue, surely it is clear that our judicial system is just too fallible to be empowered with the ability to take a human life. Time and time again, overzealous officers of the court like Judge Killer/Keller make the best cases against their own lethal authority.

Close ranks or throw her under the bus?

If only meaningful judicial reform could come from this debacle.

Logic and an open mind are more useful than common sense.

Anything less (0.00 / 0)
than removal from office would bring discredit on the Commission on Judicial Conduct, which is already perceived as a weak agency.
