Judge Rules Against Kucinich in Texas Ballot Case

Looks like Willie and Dennis will have to appeal if they want on the Texas ballot.

Dallas Morning News: Kucinich may appeal to the 5th U.S. Circuit Court of Appeals in New Orleans, possibly as soon as Monday, said his attorney, Donald McTigue. He said he would get a final decision from the Ohio congressman, who, like Nelson, was not at the Austin hearing.

U.S. District Judge Lee Yeakel said the courts should intervene sparingly in political party rule-making. While the Democrats' oath may be "inartfully worded," it does not place such a burden on Kucinich that it should be struck down, Yeakel said.

Wouldn't being on the ballot allow you to more effectively fight for the ideals you are promoting, than to fight for those ideals just to get on the ballot?

If they have to be "approved" then why can't their fucking name be on the ballot?

The office of President may be different, but as far as I'm aware for state of Texas candidates, you go through the Sec. of State and get your name listed as a write-in candidate and your pretty face gets put up on those sheets of paper in the polling booth or something.

Write-in procedures (5.00 / 1)
Been there.  Done that in 2004.  

The State of Texas doesn't allow write-in candidates in primaries.  The only way you can become the party nominee is to file for the primary by January 2, or to be named by the party to take the place of a nominee who becomes ineligible.

Write-ins are allowed for the general election, but becoming a "registered write-in candidate" takes as many signatures, or as big a filing fee, as getting on the primary ballot or running as an independent.  The only difference is that the deadline is in late August.  

If there's one or more registered write-in candidates for a race, then a box labeled "write-in" appears on the ballot, and voters have to check that box and write the candidate's name in, or spell it out one letter at a time on an eSlate.  (L-O-R-E- .. never mind)  The candidate also gets his name posted, in small letters, in each booth at the polling place.  

If there's no registered write-in candidate, then there's no way to cast a write-in vote.
