KNCT censors Mary Beth Harrell on NOW

From Al Stanley's diary on DailyKos, we have learned that last night's episode of NOW was blacked out on KNCT, the PBS affiliate serving the community surrounding Fort Hood. The episode featured a report portraying "the contrast between (Rep. John) Carter's staunch support of the war and the fact that (Democratic challenger Mary Beth) Harrell has enjoyed much acceptance in the Ft. Hood community despite questioning the war's premise and execution."

KNCT provided a completely bogus explanation for the outage. Despite the fact that almost all the PBS affiliates around the country found no problems with the broadcast, KNCT attorneys were concerned that the report failed to give equal time to the Libertarian candidate for Congress in Texas' 31st district.

A more believable explanation is developing that Carter, while at the Metroplex Health System's Gold Star Gala, told Central Texas College chancellor  James R. Anderson to stop the broadcast. Both men attended the event on Thursday, one day before the PBS national broadcast. Central Texas College owns and operates KNCT, so the chancellor has the ability to make management decisions at the station.

Harrell campaign manager Ken Stewart has issued a call to action in his dKos diary. Please read and recommend these posts. No one should be surprised that a sitting congressman, afraid to face voters and his opponent, has engaged in repeated, intentional deceptions to prevent the voters in Texas' 31st district from getting the information they need to make an informed decision. The reason is simple. Mary Beth Harrell is the most qualified, most informed and best equipped to represent us in Congress.

UPDATE: KNCT attorney Max Rudolph today told the Harrell campaign that no one from the station asked him for a legal opinion on the broadcast before deciding to cancel it. PBS attorney Josh Schwartzberg today said that the segment in last night's episode of NOW is a bona fide news interview program and, as such, is exempt from the equal opportunities requirement under Section 315(a)(2) of the Communications Act of 1934.

The excuse provided by KNCT is an outright lie. KNCT did not consult attorneys with their concerns about last night's episode of NOW before deciding to cancel the broadcast. This was a simple act of censorship by Dr. Anderson for Rep. John Carter. Carter's position on the House Appropriations committee puts him in a position to steer federal dollars toward Central Texas College. This is a craven act unbecoming of a member of Congress.

A protest at KNCTs studios will take place at 1pm. Please speak out!

Tell voters out there that this is the video KNCT didn't want them to see.  Tell them they need to make up their own mind and let KNCT censor their news.

Max Rudolph is the station manager, not the lawyer for KNCT. But it is true the station did not consult with an attorney (unless you count John Carter) before deciding to pull the plug on this program at the last minute.

It will run tonight at 8 p.m. and has received more publicity than if it had run in its normal time slot. Looks like the Carter folks shot themselves in the foot on this one.

Keep doing what you been doing, keep getting what you been getting.

Wow, the press responds to pressure.  Or how James R. Anderson learned how to intrepret the equal-time rule, like every other PBS station, that had absolutely no problem getting it right on Friday night.

Good news for Mary Beth Harrell.  I hope she got far more publicity from Anderson's mistake.

 


Equal Time? (0.00 / 0)
It should be be a big clue any time the "Equal Time Rule" is cited by management in the broadcast industry.  Generally, the "Equal Time Rule" is cited by the candidates, not the media.

Any manager who works in television or radio knows that the Equal Time Rule does not apply to documentaries, news interviews, scheduled newscasts or on-the-spot news events.  This ain't new- it's been the rule since 1959.  It's what allows shows like NOW and Bill O'Reilly (and even Oprah!) to interview candidates for their shows without being required to allocate the same amount of time to their opponents.

Most people confuse "Equal Time" with the "Fairness Doctrine".  The Fairness Doctrine was also part of The Communications Act.  It said that broadcasters could not show bias toward particular viewpoints over others.  It also said that if the proponent of an opposing opinion could not pay for air time, the brodcaster is required to provide equal air time without charge.

The "Fairness Doctrine" was abolished in 1987 under the Reagan deregulation of the FCC.  The 1987 change oddly preceded a growth in shows that favor one viewpoint over another, such as Rush Limbaugh.  It also opened the door for the founding of networks like Fox News (even though these outlets often advertise as being "Fair and Balanced").

In other words, KNCT is trying to use non-existent statute to justify their decision to censor the NOW episode.  They should be called out for it.
